Intellectual Property & Commercial License Agreement
Effective Date: 12/3/2016
This Intellectual Property & Commercial License Agreement (“Agreement”) governs the purchase and use of all physical stencil products and digital stencil files sold through LureStencils.com (“Company,” “we,” “us,” or “our”).
By purchasing, downloading, or using any product from LureStencils.com, you agree to be bound by the terms set forth below.
1. Ownership of Intellectual Property
All stencil designs, artwork, digital files, layouts, patterns, graphics, and derivative works sold or displayed on LureStencils.com are original works and are the exclusive intellectual property of LureStencils.com.
All designs are protected under United States copyright law and applicable international intellectual property laws and treaties.
Purchase of any physical stencil or digital file does NOT transfer ownership of copyright or any intellectual property rights.
All rights not expressly granted in this Agreement are reserved.
2. Grant of Limited Commercial License
Upon purchase, the Company grants the buyer a limited, non-exclusive, non-transferable, revocable license to:
Use the purchased stencil or digital file to paint or decorate physical fishing lures.
Sell physical fishing lures that have been hand-painted using the purchased stencil design.
This license applies only to finished, tangible fishing lures created by the purchaser.
This license does not permit reproduction of the stencil design itself in any format or material.
3. Strictly Prohibited Uses
The following activities are strictly prohibited and constitute a violation of this Agreement:
Reproducing, copying, tracing, modifying, reverse engineering, digitizing, or recreating any stencil design for the purpose of manufacturing new stencils.
Manufacturing, selling, distributing, or giving away stencils of any material including but not limited to vinyl, mylar, plastic, metal, or composite materials based on Company designs.
Sharing, transferring, emailing, sublicensing, uploading, or distributing digital files in any format.
Selling or offering digital files or derivative stencil files on Etsy, eBay, Shopify, Amazon, social platforms, forums, or any online marketplace.
Using Company designs to create competing stencil products.
Allowing third parties to use purchased digital files.
Mass producing stencil products based on Company designs.
Unauthorized reproduction or redistribution constitutes copyright infringement under federal law.
4. Digital File License Restrictions
All digital stencil files are licensed for individual purchaser use only.
Digital files may not be:
Shared with third parties.
Used by multiple individuals under a single purchase.
Uploaded to cloud storage for public or shared access.
Modified for the purpose of resale or redistribution.
Each purchase grants a single-user license.
5. Enforcement and Remedies
The Company actively monitors unauthorized use of its intellectual property.
Violation of this Agreement may result in:
Immediate termination of license rights.
Revocation of access to digital products.
Cease and desist demands.
Legal action seeking statutory damages, actual damages, attorney fees, and injunctive relief as permitted by law.
The Company reserves all rights to pursue infringement to the fullest extent permitted under United States copyright law.
6. No Transfer of Ownership
Nothing in this Agreement shall be interpreted as a transfer, assignment, or sale of intellectual property rights.
All stencil designs remain the sole and exclusive property of LureStencils.com.
7. Acceptance of Terms
By purchasing, downloading, or using any product from LureStencils.com, the buyer acknowledges and agrees to be legally bound by this Agreement.
If you do not agree to these terms, you must not purchase, download, or use Company products.
